Terms and Conditions

1. Platform Role

Static Services is a technology enablement and onboarding platform. Static Services does not act as a bank, payment processor, money transmitter, or Merchant of Record.

2. Payments Powered by Finix

All payment processing, settlement, payouts, and funds movement are provided by Finix Payments, Inc. and its sponsoring financial institutions. Static Services does not process payments, hold funds, or control settlement timing.

3. Acceptance of Terms

By accessing or using the Static Services platform or website, you agree to these Terms and Conditions. Continued use constitutes acceptance of updates.

4. Eligibility

Users must be legally formed businesses eligible to enter into binding contracts and comply with applicable laws.

5. Sub‑Merchant Relationship

Users operate as independent merchants or sub‑merchants. Static Services does not control pricing, inventory, staffing, or consumer interactions.

6. Finix Third‑Party Beneficiary

Finix Payments, Inc. and its affiliates, processors, and sponsoring financial institutions are intended third‑party beneficiaries of these Terms.

7. Onboarding and Verification

Users must provide accurate and complete onboarding, KYC, and business information. Approval is subject to Finix underwriting.

8. Compliance Obligations

Users must comply with all Applicable Law, Payment Network Rules, PCI DSS, and Finix Terms of Service.

9. Fees

Platform fees charged by Static Services are separate from payment processing fees, which are governed by Finix agreements.

10. Chargebacks and Disputes

All disputes, chargebacks, refunds, and reversals are governed by Finix and the applicable payment networks.

11. Prohibited and Restricted Activities

Users may not engage in prohibited or restricted business categories as defined by Finix or applicable law.

12. Refund Policy Requirement

Users must maintain a written refund policy compliant with Payment Network Rules and Applicable Law.

13. Data Use and Privacy

Static Services may collect and share onboarding and platform data with Finix to support payment services and compliance.

14. Security

Users are responsible for safeguarding credentials. Static Services implements reasonable security measures but does not guarantee uninterrupted access.

15. Suspension and Termination

Static Services may suspend or terminate access for non‑compliance, risk concerns, or Finix direction.

16. Limitation of Liability

Static Services is not liable for indirect, incidental, or consequential damages, including lost revenue or settlement delays.

17. Disclaimer of Warranties

The platform is provided 'as is' and 'as available' without warranties of any kind.

18. Independent Contractor Relationship

Nothing in these Terms creates a partnership, agency, or joint venture.

19. Notices

Static Services may provide notices electronically regarding compliance, pricing, or downtime.

20. Governing Law

These Terms are governed by the laws of the State of Florida.

21. Amendments

Static Services may update these Terms at any time. Continued use constitutes acceptance.
